General
Terms and Conditions of Supply
In these General Terms and Conditions of Supply the following words and
phrases shall have the following meanings:
"Acceptable Use Policies" means the policies set out on the Company's
Web Site relating to the use of the Services, as modified or amended from
time to time;
"Account" means the Customer's account with the Company for provision
of the Services;
"Agreement" means these General Terms and Conditions of Supply, the
Application, the Acceptable Use Policies, the Price List, and the Privacy
Policy, all of which, taken together, constitute the agreement between the
Company and the Customer for the supply of the Services;
"Application" means the application form for the supply by the
Company of the Services, completed by, or in accordance with an order from,
the Customer;
"Charges" means the charges payable by the Customer in return for the
Services described in the Agreement;
"Company" means Kantara Ltd (Company Registration Number 03277266) of
12A Warland, Totnes, Devon, TQ9 5EL;
"Company's Web site" means the Web site at http://www.kantara.co.uk,
and references to "our Web site" shall be construed accordingly;
"Customer" means the person, group of persons or other entity whose
name and address is or are set out in the Application;
"Domain Name" means a name registered, or to be registered, with a
Registry for use as part of your URL;
"Domain Name Registration Services" means the registration of a
Domain Name with a Registry and which is described in more detail on our
Web site;
"Domain Name Services" means the Web and Email services which are
described in more detail on our Web site, or any or all of them;
"Price List" means the Company's price list relating to the Services
set out on our Web site, as amended from time to time;
"Privacy Policy" means the Company's policy regarding privacy, set
out on our Web site, as amended from time to time;
"Registry" means an organisation responsible for holding and
processing all records for particular Domain Name extensions;
"Renewal Date" means the anniversary for renewal of the Service,
fixed as the date the initial Service Period ended;
"Service Period" means the period of an individual Service provided
in accordance with this Agreement; All references to "Application Period"
and "Renewal Period" shall be construed accordingly;
"Service" means a service provided by the Company to enable the
Customer to register and use a Domain Name on the Internet (and other
services and facilities provided by the Company in connection with that
service as described at http://www.kantara.co.uk), as are specified on the
Application, and described in the Company's literature at the date of
completion of the Application together with all services and/or facilities
referred to in any Specific Terms and Conditions; All references to
"Services" shall be construed accordingly;
"us" or "we" means the Company, and references to "our"
shall be construed accordingly;
"you" means the Customer, and references to "your" shall be
construed accordingly.
Services
We offer Domain Name Registration Services for a range of Domain Name
extensions including .gov.uk, .ac.uk, .co.uk, .org.uk, .me.uk, .ltd.uk, .plc.uk,
.com, .net, .org, .biz, .info and .eu.
We offer Domain Name Services including web and email services.
Application and Renewal
Registrations for the .uk Domain Name extension are maintained for an
Application Period of two years. All other Domain Name extensions are
maintained for an Application Period of one year. Thereafter, the Domain
Name Registration Service shall automatically renew for a further Renewal Period of
two years in respect of .uk Domain Names; and/or one year in respect of all
other Domain Name extensions; until and unless terminated by you upon giving
us notice to terminate prior to the first anniversary of your Domain Name
Registration Service or prior to the anniversary of any Renewal Period.
Domain Name Services are maintained for a Service Period of up to one year
having a Renewal Date aligned with the Renewal Date of the Domain Name
Registration. Domain Name Services are charged on an annual basis, not on a
pro-rata basis. Domain Name Services ordered in the first three quarters of
the current Service Period will expire at the end of the current Service
Period. Domain Name Services ordered in the final quarter of the current
Service Period will run throughout the current Service Period and expire at
the end of the next Service Period. Thereafter, the Domain Name Services
shall automatically renew for a further Service Period of one year.
We shall send you a reminder prior to the Renewal Date. If you do not wish
to renew the Services, you must notify us within 30 days from the date of
the reminder, otherwise the Services will automatically renew.
Charges for all Domain Name Registration Services and all Domain Name
Services will be payable annually in advance.
You acknowledge that our acceptance of your Application for Domain Name
Registration Services shall not constitute confirmation from us that any
particular Domain Name is available for registration as this is controlled
by the relevant Registry.
Cancellation
To cancel existing Services you have with Kantara you must have authority
over the Service. By default, permission is granted to the person who
originally ordered the service, or the current contact person authorised by
the Customer.
A written request for cancellation of the service should be
sent to Kantara from the contact person by email or by letter on the
Customer's headed
notepaper. In addition, to surrender registrations for .gov.uk and .ac.uk a
confirmatory letter to the registry, on letterhead, is also required from
the name owner, confirming the fact of the cancellation.
Refunds
Save in the case of .gov.uk and .ac.uk Domain Names, in the event that a
Domain Name is not registered and/or the Registry refuses to register a
Domain Name, we will refund the Charges in respect of the Domain Name
Registration Services to you.
Applications for .gov.uk and .ac.uk Domain Names are subject to strict
eligibility criteria which require additional use of resources to deal with.
You acknowledge that you are responsible for ensuring that your application
for a Domain Name meets the eligibility criteria.
In the event that an application produces a rejected outcome we will work
with you, upon your request, to provide any further relevant, detailed
information to the Registry so that an appeal may be lodged.
We will not refund the Charges in respect of .gov.uk and .ac.uk Domain Name
Registration Services to you.
We reserve the right to make a charge for frivolous, time-wasting or other
requests which impose an undue use of resources to deal with.
Our liability shall be limited to the refund of the Charges paid by you in
respect of the Domain Name Registration Services. We shall not be liable for
any loss, damage or claim relating to the non-registration of the Domain
Name or your reliance upon the registration of the Domain Name howsoever
caused.
